New legislative amendments bring changes to Fair Work commission functions

Effective today, the Fair Work Commission has implemented changes to its functions as a result of the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022. 

The Commission has published detailed information on its website regarding the prohibition against sexual harassment in connection with work. 

This includes application forms for the new sexual harassment jurisdiction, available on the Forms page of the Commission’s website, as well as a new email address (ABSH@fwc.gov.au) for parties to file documents and contact case managers.

The Commission can deal with sexual harassment disputes by making a stop sexual harassment order, otherwise dealing with the dispute or both. The Commission’s materials have been updated following consultations and feedback, and the Commission welcomes ongoing feedback regarding materials and processes.

Additionally, the Commission has established an Expert Panel to address gender pay equity and the Care and Community Sector when considering changes to modern awards or deciding whether to make an equal remuneration order. The newly created Pay Equity and Awards Team can be contacted via awards@fwc.gov.au.

New application forms to vary a modern award and apply for an equal remuneration order are available on the Forms page of the Commission’s website. The Commission also intends to engage in a research project on occupational segregation and gender undervaluation.

Lastly, the Commission has absorbed the functions of the Registered Organisations Commissioner, with the General Manager of the Commission taking over these functions. 

The Registered Organisations Governance and Advice Branch will assist General Manager, and ongoing investigations, inquiries, and litigation will transfer to General Manager. Conduct prior to the transfer may still be subject to potential inquiry, investigation, or proceeding by General Manager.

A new email address has been established for all registered organisations matters: regorgs@fwc.gov.au. Staff in the registered organisation’s teams at the Commission can be contacted on 1300 341 665.
