1. Agreement to these terms
Welcome to Dynamic Business. These Terms & Conditions (“Terms”) govern your access to and use of the dynamicbusiness.com website, its subdomains, newsletters, and related services (together, the “Site”), which are operated from Australia. By accessing, browsing, subscribing to, creating an account on, or contributing content to the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
2. About Dynamic Business
Dynamic Business is an Australian online publication covering business news, technology, startups, and entrepreneurship. The Site publishes a mix of content: articles written by our own editorial team, and material submitted by contributors and members of our community. Community-contributed content does not necessarily reflect the views of Dynamic Business.
3. Eligibility and accounts
You must be at least 18 years old to create an account or contribute content. When you register you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use.
4. Your contributions
The Site allows registered users and contributors to submit articles, story tips, comments, images, and other material (“Contributions”). You retain ownership of the intellectual property in your Contributions. By submitting a Contribution, you grant Dynamic Business a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sub-licensable licence to host, reproduce, edit, adapt, publish, translate, distribute, and display that Contribution (in whole or in part) across the Site and our related channels, and to promote it.
By submitting a Contribution you represent and warrant that:
- you are the author or have all necessary rights, licences, and permissions to submit it and to grant the licence above (including rights to any images);
- the Contribution is accurate and not misleading, and is your original work or properly attributed;
- it is not defamatory, obscene, discriminatory, unlawful, or in breach of any person’s rights (including privacy, confidentiality, or intellectual-property rights); and
- it does not contain undisclosed paid promotion, malware, or spam.
Dynamic Business is under no obligation to publish any Contribution, and may review, edit, fact-check, add disclosures to, decline, or remove Contributions at its discretion. Where a Contribution is sponsored or commercial in nature, it must be clearly identified as such.
5. Our editorial content
Articles and other material produced by Dynamic Business are owned by us or our licensors and are protected by copyright and other laws. They are provided for general information only. We may update, amend, or remove editorial content at any time without notice.
6. Acceptable use
You agree not to use the Site to:
- break any law or infringe anyone’s rights;
- post content that is defamatory, harassing, hateful, deceptive, or otherwise objectionable;
- impersonate any person or misrepresent your affiliation;
- upload malware, or attempt to gain unauthorised access to the Site or its systems;
- scrape, harvest, or systematically extract data except as expressly permitted; or
- interfere with the proper working of the Site.
7. Intellectual property
Except for your Contributions and third-party material, all content on the Site — including text, graphics, logos, and the “Dynamic Business” name and branding — is owned by or licensed to Dynamic Business. You are granted a limited, personal, non-transferable licence to access and view the Site for your own non-commercial use. You may not reproduce, republish, or exploit Site content without our prior written permission or as permitted by law (for example, fair dealing).
8. Third-party links and advertising
The Site contains advertising and links to third-party websites. Outbound links to external sites are provided for convenience and carry no endorsement; we are not responsible for the content, products, or practices of those sites, and you access them at your own risk. Advertising and sponsored content are subject to the terms of the relevant advertiser and, where required, are identified as such.
9. Disclaimers — no professional advice
Content on the Site is general information only and is not financial, legal, tax, accounting, or other professional advice, and must not be relied on as such. It does not take account of your objectives or circumstances. You should obtain your own professional advice before acting. To the maximum extent permitted by law, the Site is provided “as is” and we do not warrant that it is accurate, complete, current, or uninterrupted.
10. Limitation of liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, to the maximum extent permitted by law, Dynamic Business (and its officers, employees, and contributors) will not be liable for any indirect, incidental, special, or consequential loss, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Site or any content on it, whether in contract, tort (including negligence), or otherwise. Where our liability cannot be excluded but can be limited, it is limited to re-supplying the relevant service or the cost of doing so.
11. Indemnity
You agree to indemnify Dynamic Business against any claim, loss, liability, or cost (including reasonable legal costs) arising from your Contributions, your use of the Site, or your breach of these Terms.
12. Suspension and termination
We may suspend or terminate your access to the Site or your account, and remove any content, at our discretion — including where we reasonably believe you have breached these Terms. Provisions that by their nature should survive termination (including licences you have granted, disclaimers, and limitations of liability) will continue to apply.
13. Changes to these terms
We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
